Payment Terms Each educational service, including subscription packages and course bundles (collectively \"Educational Services\"), is offered at prices listed on relevant pages. All fees are in U.S. dollars. To purchase Educational Services, you must provide valid payment information. You represent and warrant that you are authorized to use any Payment Method you provide. You agree to pay for all services you purchase. We may charge your selected payment method through our third-party payment processor. If payment fails, we may use other collection methods and may suspend or terminate your access to Educational Services. Your payment provider may charge additional fees (foreign transaction fees, processing fees, etc.). Local taxes may apply depending on your location. Subscription Terms Some Educational Services are offered on a subscription basis with recurring payments. After 14 days, all payments are non-refundable. Subscription Renewals: Recurring subscription payments are non-refundable. Cancel before your renewal date to avoid being charged for the next period. Course Completion: Accessing or completing significant portions of course materials may disqualify you from refund eligibility, at our discretion, even within the 14-day window. Refund Processing: Approved refunds are processed within 7-10 business days to your original payment method. Agreement to Arbitrate Please read this arbitration provision carefully as it affects your legal rights. Application This arbitration agreement applies to any dispute between you and Team Bull Trading except: Small claims court cases (under $10,000)Intellectual property disputesClaims that cannot be arbitrated under applicable law Arbitration Rules and Forum The Federal Arbitration Act governs this agreement. Arbitration will be conducted by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. We will attempt to resolve the dispute within 30 days of receiving the Notice. If we cannot reach an agreement, either party may commence arbitration. The arbitrator shall issue a written decision explaining the findings and conclusions. The arbitrator may rule on fee disputes at any time during the proceeding. Limitations to Arbitration Each party is limited to three (3) witnesses and 200 pages of documents. No Class Actions YOU AND TEAM BULL TRADING AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS PART OF ANY CLASS OR REPRESENTATIVE PROCEEDING. Unless both parties agree otherwise, the arbitrator may not consolidate claims or preside over any class proceeding. Opt-Out New students may reject this arbitration agreement by mailing a written Opt-Out Notice postmarked within 30 days of accepting these TOU. Mail to the Notice Address above. The Opt-Out Notice must include your name, address, username, email, and signature. If you opt out of arbitration, all other TOU provisions remain in effect. Modifications to Arbitration Agreement If we change this arbitration provision (other than the Notice Address), you may reject the change by written notice within 30 days to the Notice Address. Rejection results in immediate account termination, and disputes will be arbitrated under the original language. WE DO NOT WARRANT THAT: Educational Services will meet your specific learning needsContent will be error-free, accurate, or currentAny particular educational outcome will result from our trainingAccess to The Sites will be uninterrupted or secure Severability and Enforceability If any provision of these TOU is held invalid or unenforceable, that provision shall be enforced to the maximum extent possible, and remaining provisions remain in full effect. Entire Agreement These TOU constitute the entire agreement between you and Team Bull Trading regarding Educational Services and may only be amended by written agreement signed by authorized representatives. No Waiver Our failure to enforce any provision does not waive our right to enforce it later. No waiver of any breach constitutes a waiver of any other breach or of the provision itself. Assignment You may not assign or transfer your rights under these TOU. We may assign our rights to any affiliate or successor without restriction. Governing Law These TOU are governed by Colorado law, excluding conflict of laws principles, and the Federal Arbitration Act.
